Usher and Justin Bieber are facing a massive copyright infringement case. About two years after the original lawsuit was filed, the “Somebody to Love” case was approved to move forward.

The two singers are now facing a $10 million lawsuit, according to Reuters, as a coupe of Virginia songwriters claim they stole their music without
any permission. Apparently, the version of the plaintiffs – singer De Rico and writer Mareio Overton – was played for Usher and Bieber before the track in question was recorded a few times

“ After listening to the Copeland song
and the Bieber and Usher songs as wholes, we conclude that their choruses are similar enough and also significant enough that a reasonable jury could find the songs intrinsically similar," a circuit judge wrote of the decision.

Here comes the tricky part. The songwriters presented the original track as an R&B song, but despite the fact Ush and his collaborator transformed it into “dance pop, perhaps with hints of electronica,” the judge approved the lawsuit. The latter claims that to rule against the suit because of the genre shift would open up a legal precedent and grant other artists the opportunity to cover protected material by transforming the “concept and feel.”
